    people frequently misunderstand the first amendment. trump doing it isn’t shocking but it is disappointing. he is basically abusing the term “free speech”. he’s the government. twitter is a private company. he would be violating their free speech if he tried to shut them down or get them to comply with his bullshit lies.

    Yeah. I'm so used to see private citizens screaming that their first amendment rights are being abused when their employers fire them for saying horrifically awful things online. I've just never seen the fucking POTUS do the same thing...and then actually attempt to ACT ON IT.

    Is it safe to assume that whatever stupid ass thing he signs, there will be lawsuits within 24-48 hours and hopefully a court overruling it?

    Exactly. The Constitutional right to free speech protects you FROM THE GOVERNMENT. It means the GOVERNMENT can’t come after you and arrest you for your speech (with limits, like hate speech or insurrection etc.).

    I still can't believe that we've arrived at a point in history where a large enough group of people are outraged because they ACTUALLY THINK the fucking GOVERNMENT is being censored by a private company.

    I am just going to have to stay baffled by this one.

    Section 230 is part of the Communications Decency Act.

    The Communications Decency Act of 1996 (CDA) was the first notable attempt by the United States Congress to regulate pornographic material on the Internet. In 1997, in the landmark case of Reno v. ACLU, the United States Supreme Court struck the anti-indecency provisions of the act.

    The act was title V of the Telecommunications Act of 1996. It was introduced to the Senate Committee of Commerce, Science, and Transportation by Senators James Exon (D-NE) and Slade Gorton (R-WA) in 1995.[1] The amendment that became the CDA was added to the Telecommunications Act in the Senate by an 81–18 vote on June 15, 1995.[2]

    As eventually passed by Congress, Title V affected the Internet (and online communications) in two significant ways. First, it attempted to regulate both indecency (when available to children) and obscenity in cyberspace. Second, section 230 of the act has been interpreted to say that operators of Internet services are not to be construed as publishers (and thus not legally liable for the words of third parties who use their services).

    Section 230 of the Communications Decency Act was not part of the original Senate legislation, but was added in conference with the House, where it had been separately introduced by Representatives Christopher Cox (R-CA) and Ron Wyden (D-OR) as the Internet Freedom and Family Empowerment Act and passed by a near-unanimous vote on the floor. It added protection for online service providers and users from actions against them based on the content of third parties, stating in part that "No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider." Effectively, this section immunizes both ISPs and Internet users from liability for torts committed by others using their website or online forum, even if the provider fails to take action after receiving actual notice of the harmful or offensive content.

    Through the so-called Good Samaritan provision, this section also protects ISPs from liability for restricting access to certain material or giving others the technical means to restrict access to that material.

    On July 23, 2013, the attorneys general of 47 states sent a letter to Congress requesting that the criminal and civil immunity in section 230 be removed. The ACLU wrote of the proposal, "If Section 230 is stripped of its protections, it wouldn't take long for the vibrant culture of free speech to disappear from the web."

    Here's my concern though: Trump = free money for Twitter. So while they might up the banning and other censorship of plebes like you and me, they sure as shit aren't going to do something like block his account or delete each and ever blatant lie that he posts.

    They should. But they won't. I will print this message and eat it if they actually ban his account in order to reduce liability.

    He won't shut them down, and they won't shut him down. All that will come of this is that MAGA chuds will have another reason to feel attacked and it will solidify their support for Trump.

This opinion has nothing to do with the fact that I despise Twitter for all the reasons that I think Trump loves it. There's just too much at stake at this point, and I wouldn't want to have history remember me as the mouthpiece of The Great American Fascist Moment.

    I wish both Twitter and Facebook were FORCED to shut down during the lead-up to elections. I hate Trump, but Section 230 DOES allow social media to act like innocent bystanders when they’re really publishers with millions and millions in advertising money without any care as to curation or social responsibility. They are totally unregulated by the FCC. It’s a free-for-all. People can LIVE STREAM A MURDER ON FACEBOOK. And Facebook shrugs and says “but free speech.” The abuse and propaganda on Twitter is INSANE. With very little oversight. And the oversight that IS there is doled out SO irregularly, it makes zero sense. Conservatives whine that they’re primary targets on Twitter, but that’s BULLSHIT. I’ve been in Twitter jail at least 6 times. I’m on at least my 8th account since 2008. These fucking MAGA stalkers are crazy. The Bernie wackos are almost as bad (many are now teaming up with the Trump people). It’s like a fucking cesspool BECAUSE it’s unregulated. Something as big and as profitable without any form of speech regulation is ANARCHY. There is hate speech, there are thousands of people insisting that Michelle Obama is a DUDE, it’s just nuts. And leaving threats up? FROM THE PRESIDENT? WHAT THE FUCK.

    @allegro , I've worked gigs in some spots where people don't think the way I do, and I've heard people joke about how Michelle Obama is a man. It's really bizarre. I bite my tongue; I'm not there to make friends, I'm there to do my job well, get a paycheck, and leave.

    Anyway, right NOW seems like a wise and pivotal time to cut ties with the WHO doesn't it? I mean, why wait? What kind of smart, thoughtful leader wouldn't think it was the perfect time to sever ties with the World Health Organization.
