If the Special Counsel comes across a crime not related to the investigation during the investigation, he is not only allowed to refer it to the proper authorities, he is OBLIGATED to refer it to the proper authorities.
In this case, Cohen and campaign finance violations or bank fraud related to the Stormy Daniels NDA or just plain old tax evasion conducted by Cohen or about 20 other improper things done by Cohen.
And Trump threw Cohen under the bus the other day while entering Air Force One and reporters asked Trump if he knew anything about the Non Disclosure Agreement (NDA) and Stormy Daniels and Trump said “No.” Reporters then asked if he was aware of a $130,000 payment to Ms Daniels and Trump said “No, you’ll have to ask Michael (Cohen).”
So - this is NOT attorney client privilege (Trump TOLD REPORTERS TO ASK MICHAEL COHEN), Trump stated publicly that he did not know about the NDA or a payment.
So here we go again with Monica Lewinsky meets John Edwards.

But for the privilege to be nullified, Litman said the taint team would have to get the approval of the court to present the material to the prosecution.
In order to fall under attorney-client protection, the documents just have to be related to Cohen dispensing legal advice or gathering information in order to give that advice, Litman said. But merely having an attorney involved does not guarantee the protection.
"It can’t just be that somebody with the bar degree is in the general vicinity," Litman said.
Based on his experience with cases involving issues of attorney-client privilege, Litman said is likely that the prosecution never sees 80% or more of the documents.

Cohen used his HELOC (home equity line of credit), which is INTENDED to be used for your HOME, since it COLLATERALIZED your HOME, to pay Stormy Daniels per the NDA; the bank reported it to the Treasury Department; bank fraud; this ain’t no “witch hunt.”

Cohen is an idiot, and it’s likely that Trump’s CURRENT attorneys advised him to stay as far away from Cohen as possible.

Dershowitz has sucked for a very long time now. I remember way back after 9/11 reading his asinine theory on why the government has right to torture people. And he's always throwing these temper tantrums anytime he thinks the Dems might possibly veer away from his preferred brand of milk toast centrism, like when he threatened to leave the whole party if Keith Ellison was elected party chair. Nowadays he's constantly rushing to Trump's defense. He just consistently takes up the stupidest positions on everything.
