Firstly, because I just read this in trying to find out more:who other than the Supreme Court has jurisdiction on the land of the United States? If the treaty stands, it’s to be tried in a Federal court; if it doesn’t, it’s tried in the Oklahoma state court system.

Gorsuch’s opinion begins:

“Today we are asked whether the land these treaties promised remains an Indian reservation for purposes of federal criminal law. Because Congress has not said otherwise, we hold the government to its word.”

As Indian law cases go, the dispute in this one is easy to understand: whether the land once granted to the Creek Nation as a reservation retains that status. Gorsuch begins by documenting the clarity of the historical record establishing the creation of the Creek reservation: a series of treaties and statutes that, among other things “solemnly guarantied” the land to the tribe, “forever set apart as a home for said Creek Nation,” “no portion [of which] shall ever be embraced or included within … any Territory or State.”

Gorsuch then turns to the question of whether “the Creek Reservation persists today,” recognizing “that Congress has since broken more than a few of its promises to the Tribe,” and that Congress unquestionably has the raw power to disregard those promises and destroy the reservation. On that point, Gorsuch emphasizes that the power to terminate the reservation “belongs to Congress alone,” and that “this Court [will not] lightly infer such a breach.” Introducing a theme that dominates the opinion, he explains that “States have no authority to reduce federal reservations lying within their borders”; giving States that power “would … leave tribal rights in the hands of the very neighbors who might be least inclined to respect them.”

Add the hour and minute hands and done.

Each of those steps, though, measures some cognitive ability. The circle itself. The positioning of the numbers, which requires more planning ahead than you might consider. The placement of the hands from center to number. These are simple, discrete tasks that a normal brain can easily complete — as readily as one can recite the alphabet. If you have impaired cognitive functioning, though, it’s not easy at all.

All of this is why the test itself shouldn’t be scoffed at for being easy. All of this is also why one shouldn’t brag about doing well on the test.

Which brings us to Trump’s recent invocation of the cognitive test he took. The president and his allies have invested a lot of energy in questioning former vice president Joe Biden’s mental acuity, given the likelihood that Trump and Biden will face off in November.

At a news conference late last month, a Fox News reporter asked the presumptive Democratic presidential nominee if he had been tested for cognitive decline.

“I’ve been tested. I’m constantly tested,” Biden replied, apparently meaning in the abstract and not with specific tests like the one Trump took. “Look, all you’ve got to do is watch me — and I can hardly wait to compare my cognitive capability to the cognitive capability of the man I’m running against.”

When Trump called into Sean Hannity’s Fox News show last night, Hannity raised the interaction, showing a series of incidents in which Biden stumbled over words.

Trump, oddly, insisted that Biden must have meant tests for the coronavirus, which Biden clearly didn’t. But then Trump raised his own cognitive test.

“I actually took one when I — very recently, when I when I was, you know, the radical left was saying, ‘Is he all there? Is he all there?’ And I proved I was all there because I — I aced the test,” Trump claimed. “And he should take the same exact test. The very standard test; I took it at Walter Reed Medical Center in front of doctors."

Trump then turned it up a bit.

“And they were very surprised,” Trump said of the doctors. “They said that’s an unbelievable thing. Rarely does anybody do what you just did.”

No. That did not happen. Or, at least, it didn’t happen without a qualifier like, “rarely does anybody your age not demonstrate any of the impairments this test is meant to measure,” which is possible. But the doctors did not call this “an unbelievable thing.” It would be like my fawning over your alphabet recitation: “Wow, you even nailed the L-M-N-O-P.”

Getting a perfect score is literally the baseline for being normal, not for being exceptional.

That 1-a-2-b-3-c one was the one that gave me the most trouble when I did the tests, mostly because I kept forgetting the rule of number-letter-number. Which was key to the results because it was all of the memory tests that I did poorly on. Remember these five numbers, have a conversation, then recite the numbers. That kind of thing.

But at least I can admit I have a problem and have worked on ways to get around it.

The ONLY thing the DACA opinion did was state that an Executive Order can REMOVE an Executive Order.

It did NOT argue the VALIDITY of said Executive Order, or lack thereof. It only stated that the Department of Homeland Security (the Plaintiff) required proper reasoning and proper standing for bringing the suit, which it did not.

Trump is a moron.

If he tries establishing a new healthcare system via an EO by removing the ACA, he will cause CHAOS in the healthcare industry beyond anything ever experienced in history. It took over a YEAR for all hospital billing departments to revise all of their systems to conform to the ACA. People had to take CLASSES for this shit.

I was just coming in to bring up this Q Anon thing. It really seems to be gaining momentum, and I wonder if a lot of the people with Q-styled avatars or T-shirts or bumper stickers even really know what the hell it's insinuating. It's like, Trump is secretly Captain America, and he's undercover in the deep state to put a stop to satanic Democrat pizza sex-traffic-ring that's all funded by George Soros... So, checks and balances. How goes everyone’s faith in these? I’ve been a US citizen for maybe 6 months now, and I’ve gotten myself a lovely Barnes and Noble hardback on the Constitution, replete with the Federalist Papers and the like. It's fascinating stuff- that First Amendment for example.

It's very clear to me that the machinations of checks and balances are not guaranteed, but instead agreed upon, to work. So if enough people decide not to enforce them, they won't work, and democracy / the American experiment gets knocked on its ass.

Reason why I’m asking, is because everyone, literally everyone, expects Trump to lose the election, but try to stay in power.

I personally think such an attempt would fail first time out, but we have Storm Troopers on the streets, and that's clearly the work of Bill Barr. I don't like the odds that such an attempt would be unsuccessful in 5 years, if Trump actually wins this time out. I suspect this is the gambit, too.

Exactly. They already knew that both Russia and China had attempted hacks into the RNC and DNC relatively recently. They know that China and Russia were influencing the election in favor of Trump and Iran is against Trump. If China flips on Trump, whatever. Because BOTH sides are being infiltrated, but MOSTLY in favor of Trump by Russia. And then Trump is using his position as President to basically conduct a Coup. He’s using the Post Office as a weapon toward election interference. And I hope he and DeJoy go to Federal prison for this, alone (it’s a Federal crime to mess with the mail service).

Don’t get me wrong: I’m not saying I want to see China or Iran hack the election and change results. That’s wrong. But if they infiltrate social media, just like Russia does, and fill it with anti-Trump propaganda and “October surprises,” thereby “influencing the election with FACTS,” then fucking go for it.

Since Bloomberg never came through with HIS threats promises.

I’ve been donating $ to the Lincoln Project* because the DNC is in the fucking 60s. I get texts from DNC volunteers asking if I want to make PHONE CALLS. I answer no, because phone calls and canvassing have been proven to do absolutely nothing, and what we need is big social media presence and advertising.

It's the only effective form of "political telemarketing" I've seen, where at first you think you're getting a spam call, and then I was asked if I'd like to ask my congressman a question, and if I'd be willing to wait in line to participate in a telephone town hall... and you had republicans calling in and screaming at him, and he handled it gracefully, and then dismantled their points respectfully. He took as many questions as he could, and he gave well thought out, patient answers.

I kept thinking the whole time that THIS is what you should be doing if you want to get me feeling involved when I'm sitting here, doing nothing. It was great. A few months later I got another blind call to join another Ted Lieu town hall.

Unfortunately, that's the only sort of thing even remotely related to telephone canvasing that I've found interesting.

oh for sure... I guess I just felt it was worth remarking upon, because he obviously had a team put together handling questions and working with the wait line, it would have needed some planning and organization.

And it felt immersive and kind of important in how it involved me. I hardly knew who Ted Lieu was before that blind town hall call, and I found myself looking him up. He's great.

I guess I'm just saying that I think phones work, people just aren't using them right. Cold calling me up and urging me to vote for someone doesn't do shit... but inviting me to ask a politician a question directly in front of an open forum? Engaging voters (in a discussion that could potentially be huge if you really put some cash funding into it) is the end goal I think...

Unfortunately I don't think that either of the examples you've mentioned would do it.

He's made comments about fucking his own daughter, and openly talked about liking young women (which at some points could have been taken as meaning young enough to be creepy as fuck but not young enough to be illegal, but now seems likely to have meant something else).

And Kushner also cancelled his national testing plan because they thought the virus would ravage democratic states and that they could then blame the governors and that it would help him politically, so realistically we already know that he's allowed death tolls many, many times higher than 9/11 because he thought they wouldn't hurt his interests.

His supporters are a lost cause, they will never stop believing, they're too far into the cult fanaticism. It would take interventions on a mass scale.

Trump's base is estimated to be only 38% of voters. If that. Some of them already shifted away. But, what's left is solidly there, and nobody is interested in converting them.

What advertising is aimed at is Republican voters who aren't Trump's base, and Independents. And Democrats; getting MORE Democrats out to vote; INCREASING the Democratic voting base.

It's already estimated that a HUGE number of young voters will turn 18 this year, and most of them are NOT going to be voting for Trump. Efforts are under way to be sure they get registered and that they VOTE. NOT for Trump.

Elderly voters; many had voted for Trump. But then Trump didn’t protect them during a pandemic, and Trump is demanding that payroll taxes be reduced (payroll taxes ONLY affect funding for Social Security and Medicare and reducing payroll taxes threatens both). Elderly often vote by mail; Trump is now against that, and his new Postmaster General is deliberately slowing down mail. This could force the elderly - the most vulnerable Covid population - to the polls during this pandemic.

He is under the mistaken impression that mail-in ballots are when the Secretary of State mails a bunch of ballots, totally unsolicited, to voters, whether they’re registered or not. Like junk mail.

This, he believes, leads to voter fraud and ballot harvesting.

Except states are mailing ballot APPLICATIONS after they’ve been REQUESTED. These ballot applications must pass the same strict scrutiny as any other.

And ballot harvesting happens with absentee ballots, too.

Yosemite is a made-up word anyway, it's a European corruption of the name of the Indigenous band who lived there for hundreds if not thousands of years, the Ahwahnechee (who called the valley Ahwahne). They couldn't even properly pronounce the name of the group they were committing genocide against. So we called the place they used to live Yosemite. Guess you learn something new everyday?

You’re Canadian. I don’t think you grok this. Yosemite is THE biggest tourist destination in the United States. It has, as Trump mentions, “Old Faithful,” among other geological interests, flora and fauna. Every American child can read that word. It makes zero phonetic sense, but so do lots of other words so it has do be memorized. It requires comprehension while reading. That’s obviously NOT happening, here.

If Trump read “ Ahwahne,” exactly ZERO Americans (probably even living Native Americans) would know WTF he was talking about. True communication requires a message to be sent and understood by its intended audience.

My issue is that he doesn’t PRACTICE his speeches. It’s obvious. If he’d at least be COGNIZANT of this issue, he could HIDE this issue. But he obviously sees it as a weakness. If he read the speech in advance, practiced, they’d have highlighted that word or spelled it out phonetically for him so that he wouldn’t stumble. There are ways to ASSIST public speakers with these issues.

I think you might not see it how we do because you didn’t live in the USA all your life. For a functioning adult who has lived his entire life in the USA, hugs the USA flag, says he’s the most patriotic person... and he can’t read the word “Yosemite?!” That would be like if he had a hard time saying “apple pie” or “baseball.”

I actually do think there’s something wrong with him, and when he goes around celebrating that he passed the “very hard” basic cognitive exam, it doesn’t help his case. Maybe he is hiding that he has a reading disability, maybe it’s much more serious. It’s even worse that he does it TWICE in a row though... if he just flubbed it once, but no, he repeats, as if to correct himself, and says it wrong again.

In a month, Trump will hold a rally and proudly say the word “Yosemite” correctly, and his supporters will lose their fucking minds applauding... just like they did when he managed to drink a glass of water with one hand

Everyone should see the Grand Canyon. It's insane, all of that part of Arizona, the Painted Desert etc... it's kind of mind blowing. I didn't expect to be as wowed as I was, especially because I remember seeing it as a kid and thinking it was "neat."

On that note, I haven't been to Yosemite since I was a little kid, and I have no memory of it. Maybe I never even was there; maybe everything I know is a lie. I still can spell it and say it out loud, and I know where it is.

The first time I knew of Yosemite, was Yosemite Sam. I was a child of the 80s, and I grew up in the middle of nowhere.

Surely the Angry Cheeto had time in the 80s in between dragging his knuckles across the ground to watch a cartoon?

Regardless, I learned about ALL of the national parks in middle school. When I heard Yosemite, it all clicked for me. Not that hard. I'm fairly certain the kids who decided to drop out of school still knew how to pronounce that word.

Not sure how I feel about how this will play out. If there's a crime you need to go after it, and that's your job... but the very idea of dissolving the NRA is going to get some people to freak the fuck out... and those people are exactly the kind of people I'd rather not get riled up right now. It's going to land as "DEMONcrat New York Attorney General wants to take our guns away! They're going after Wayne!!"

It's not about what I think the issue is. It's not about facts or reasoning. That's not how that works. Gun control issues are statistically speaking, something of a gateway drug to the far right. I understand how the nra I'd corrupt and that this is about fraud and I'd be happy to see them go down.

Something snapped for me today.

I watched a supercut for his recent interview on Axios. One question and his answer in particular made my blood boil and officially made me 100% sick of this fucking clown. We're in trouble. If anything this current break down, spurred on by the virus, has been a long time coming. This is the result from decades of broken policies, neglect and greedy glad-handing of bought and sold for politicians who are too stupid, lazy and complacent to do their alleged job. If these ivory tower losers think the protests and rioting stuff was bad already, shit is gonna get worse if these fucking fools in congress don't get their shit together to handle the turmoil exploding in all areas of plight (food, income/jobs, housing/evictions, etc).

except it is not a gun control issue. we will still have the 2a (and it’s implications) if the nra was dissolved. the nra was used to funnel russian money to trump in the 2016 election. of course trump the liar would twist it. that’s what he does. russian meddling in the election has left us with the worst person in charge during a pandemic. the AG is doing her job by taking action. this is what she’s supposed to do.

we still have to do what’s right even if it’s viewed as political. the reason we are stuck with the fake president during the pandemic is because the GOP chose to be political instead of doing what’s right at the impeachment trial. if they had chosen removal, maybe (i know it’s a stretch) pence and pelosi would’ve come up with a testing plan and we’d be on the other side of the pandemic. a month and a half ago trump said he told his people to slow the testing down. congress has done nothing about that. they should’ve had special hearings on what could be done about testing and find out if there’s anything malicious happening to slowing down testing. people are dying daily. a rapid testing and tracing plan two months ago could’ve made a huge difference in where we are right now. none of that happened because the senate dems don’t want to be political. they’re waiting for america to vote him out. fuck all the senate for doing nothing during the pandemic. $1200 isn’t shit. fix the testing so we can go back to life.

The fact he was even elected shows how broken our political system is. To tell me my attitude is why he was elected is part of the problem why he's even here. I looked up the definition of a lame duck before I tossed the word out there to refresh my 6th grade knowledge prior to posting. It's basically a worthless president on his way out. I consider Trump as such. Only fault with me labeling him one is that there's not elected official after him while he's in his last term. I mostly just consider the term a definition for labelling something worthless.

My jaded opinion on the matter for the whole rant was that we hold the presidency to such high standards that we ignore all the worthless assholes in Congress for any of the blame for what we experience during each term. They're equally as responsible for the knee jerk reactions from voters when Presidential Elections come around. Status quo never changing is why we got Trump. He was "different" so people took a gamble on him. It failed. For some reason that's the only election in this country people seem to worry about is the Presidential one and I never understood why.

That was my whole tirade about focusing in on him by analyzing his ridiculous shit and being serious about it. Most of his shit is theatrical hamming it up for the public. I just don't think the dysfunction in the government should only be rested on his shoulders. His cabinet (every fucking stupid firing and hiring cycle) and Congress are as much to blame as he is.

I understand the temptation to believe that Trump thinks he’s a lame duck so he can suffer no consequences; but that’s clearly not true: If he’s not re-elected, he can be criminally indicted on all of the charges for which he was impeached, plus more currently pending in the SDNY. The statute of limitations on those run out during what would be his second term. If he’s serving as President, he can’t be indicted per the OLC memo and the statute would have tolled by the time he’d finished his second term.

Which is why he’s lying, cheating and stealing to win this election.

Technically, a lame duck President is one in their second term or has already been replaced. So the term isn’t being used correctly, here.

I've seen the point extended to describe a president who has no real power, or is in whatever we'd call the opposite of a supermajority. But yes.

trump going on twitter and saying “play college football” is so fucking atrocious. i do not care about any football but at this point it’s 100% his fault we can’t do college football. rapid testing and tracing are the only way. he needs to come around to this somehow or it’s gonna be a long winter.
