the stain of Trump lives on. the next task- a far more difficult one- is to get rid of Trump/Q-Anon people in govt at the state and local level. they have infested the govt and have poisoned this country.Oh, trust me. I know. We're still fucked, when 45% of Republicans think the insurrection was cool, 3/4 think that Biden wasn't legitimately elected, and 80 something percent of them still approve of trump.

We're still fucked, when Trump's already the frontrunner for the 2024 Republican primary, by football numbers. Second is Mike Pence, the guy Trump basically told a mob to go kill. That will be an interesting debate.

I'm just trying to have one little moment of peace, here.

I'm just saying, at least Trump will be out of the white house in a matter of hours, and the country didn't end YET.

It's really appalling that there's no kind of safeguards from allowing a lame duck president to do whatever the fuck he wants in the ~3 months that he's aware he is no longer president. Oh wait, I guess there "are" but congress won't do anything about it, so it's utterly pointless. Pardons and such should 100000% be restricted from happening (and yes I'm well aware of Obama's notable pardon(s) days before his second term was up), but I guess we've never legit had a fucking crazy person in office until now.

I wonder what other Presidents used this and on whom.

I watched some interesting discussions about this secret pardon thing on TV last night, and all attorneys who were experts in the subject agreed that the pardons do not have to be in writing but they must at least be conveyed to the proper authorities who can then implement them, and they must also be at least verbally conveyed to the intended recipient so said recipient can accept or reject said pardon. At such time the proper administrative authorities receive said pardon (or whatever other pardon-type action), it is most definitely no longer a “secret” as it must pass through dozens more people to make it happen.

See “Burdick” https://en.m.wikipedia.org/wiki/Burdick_v._United_States

So the definition of “secret” appears to be “not a list provided to the public.” But the reality is that all of them will somehow become public.

However, I agree with the bill that would require all pardon actions to be published.

So Trump pardoned Steve Brannon, Lil Wayne, Kwame Kilpatrick.

Let’s think about that: Trump pardoned the guy who ran a fraudulent organization that screwed a ton of people out of millions, claiming to be raising money to “build Trump’s wall” (Bannon).

Trump also rescinded his Executive Order that banned all Cabinet members from working as Lobbyists for 5 years.

I honestly DO NOT UNDERSTAND why an outgoing president, no matter the part, can just pardon people...on what feels like a whim. That's so fucked up to me, obviously it's there for people who have obviously been screwed but are stuck in red tape, but it's still really fucking strange to me this can be done on their last day. Read through all of the pardons/commutations obsessively (even went as far as to look up charges for those not mentioned).
It's a mix of everything from drug charges to high level corruption and fraud. A lot of them were supported by local/regional/national politicians.
A worrying amount were supported by celebrities...

Doesn't seem to be the case but I'm basing that on the fact that no reporting has indicated as such. 90% of the names on the list mean nothing to me but I'd assume reporters would zoom in on that pretty quickly.

The Bannon and, to a lesser extent, Broidy pardons are curious because they could be witnesses on a whole host of issues, including impeachment. This also explains why some names aren't on the list. Sure, they could be hidden but we'll find out eventually, not just if they are indicted, but also if they are witnesses.

Edit: Tapper has a thread going adding context to some of the pardons. Not sure how deep he's going on this but it's a start...

I've said this before, possibly here in one thread or another, the majority of Trump's pardon / clemency actions are projection and these seem to be no different.

I feel too much relief to even begin to comprehend what the last four years have wrought into words. Many of you are better at it, and your insights into what has gone on has given me clarity, a few laughs and a lot to think about. The full breadth of damage done, maybe irreparable, is horrifying to think about. Much will be mended for sure, but everything this administration did to upset the apple cart, is surely going to still cost us.

They’re never going to turn on him. McCarthy already changed his tune, from “Trump bears some responsibility (https://www.npr.org/sections/trump-impeachment-effort-live-updates/2021/01/13/956452691/gop-leader-mccarthy-trump-bears-responsibility-for-violence-wont-vote-to-impeach)” to “everybody across this country is responsible (https://www.motherjones.com/politics/2021/01/kevin-mccarthy-capitol-insurrection-trrump/).” Because none of them want to look complicit. They’re pointing fingers away from themselves, implicating antifa, BLM, “Americans,” anyone else in order to take the heat off of Trump and themselves. They’re carefully (publicly) focusing on the language of Trump’s speech from January 6th, and how it “didn’t incite an insurrection,” purposely redirecting attention from the MONTHS of incitement that led up to that day (including a shell company Trump set up to finance the rally), as well as the language THEY used to fuel the lies that fired up the insurrectionists.

If TRUMP is guilty, then THEY’RE guilty by default. It’s contributory negligence, liability. Digging their own graves.

Because the next people in line for charges of violating the 14th Amendment are THEM. So their only defense is Trump’s defense. Because they put themselves in his boat long ago and if he sinks, so do they.

Only those Republicans who never bought into the election fraud bullshit or who publicly distanced themselves from it come away clean.

It’s FAR too late for mea culpas. Defense lawyers have obviously been VERY busy.

I thought the pardon power would have to come from Mike Pence? That's what people were speculating about for a while, whether Trump would just resign and get Pence to pardon him.

In what other way would Trump be pardoned besides Biden (which he'd be crazy to even consider as far as I'm concerned)? I didn't think Presidents could pardon themselves. Or this is just some technicality due to absence of a clear law/rule that people are worried about having happened? I know that the secret pardons are a thing but for a sitting President? What?

That could be a win-win, if that's a possible outcome. The Republicans can say, "I wasn't going to vote in an unconstitutional impeachment", Trump gets convicted so can never run again, and gets disgraced in the eyes of history. This might actually happen.

Edit: Not to mention the more who don't show, the worse those remaining will look for voting to acquit. Like if it was just Ted Cruz who remained, he'd look like an even worse prick.

i just went through Don jr’s tweets looking for the one with video of them backstage at the jan 6 rally and it’s been deleted. i remembered it yesterday when i heard the house managers were done with their presentation. it should’ve been part of the evidence. they’re waiting for something and have a live feed of multiple cameras. it’s unclear where those cameras were but what is clear is trump was watching them backstage.

Explanation:
That video depicts Trump and the Trump family (sans Melania) in backstage tents before Trump made his speech to the rally that day. It’s not really relevant to the argument of incitement. He was there waiting around backstage until it was his turn to talk; Donnie Jr. was all fired up; the President is just standing around talking with advisors. This isn’t a good “legal” example of “inciting a crowd.” If anything, it might appear that he thinks this is JUST a rally.

New details about Trump-McCarthy shouting match show Trump refused to call off the rioters (https://www.cnn.com/2021/02/12/politics/trump-mccarthy-shouting-match-details/index.html)

Washington (CNN) In an expletive-laced phone call with House Republican leader Kevin McCarthy while the Capitol was under attack, then-President Donald Trump said the rioters cared more about the election results than McCarthy did.

"Well, Kevin, I guess these people are more upset about the election than you are," Trump said, according to lawmakers who were briefed on the call afterward by McCarthy.

McCarthy insisted that the rioters were Trump's supporters and begged Trump to call them off.

Trump's comment set off what Republican lawmakers familiar with the call described as a shouting match between the two men. A furious McCarthy told the then-President the rioters were breaking into his office through the windows, and asked Trump, "Who the f--k do you think you are talking to?" according to a Republican lawmaker familiar with the call.

Sheer madness.

I have no doubt that Republicans will be "deeply concerned, if true," and then vote not to convict anyway.

I don’t see how that’s possible. Will Republicans largely waste time here? Of course. Are they still going to acquit? Yes.

Still, won’t it be worse for Republicans to have so many witnesses dropping damning testimony on Trump?

What am I missing here?

It’s a waste of time.

He won’t be found guilty here.

He needs to be indicted and then judged by a REAL jury (not a partial one).

There’s only one Article of Impeachment for incitement. There should have been a few more, for dereliction of duty and violating the 14th Amendment.

So the DOJ should investigate him for all three, then file criminal charges.

One thing is REALLY clear to Republicans: Trump threw Mike Pence under the bus. Even Nikki Haley is slapping Trump over that, saying Trump is over. She’s right. His political career is done, mostly for what he did to his own Vice President, but for everything else. No donors will support him. His businesses are failing. His sycophants will move on when they realize there is no plot and he really isn’t the President. They are idiots with the attention span of a rat.

Yeah, he's dead and buried regardless. The new testimony is the final nail. There's a very good chance that this is being set up to pass over to the DOJ, to do just that. Neither the GOP or Democrats ever want something like this to happen again (for the most part).

"There's no question — none — that President Trump is practically and morally responsible for provoking the events of the day. No question about it. The people who stormed this building believed they were acting on the wishes and instructions of their president,” McConnell said. “The leader of the free world cannot spend weeks thundering that shadowy forces are stealing our country and then feign surprise when people believe him and do reckless things."

He then stated: “We have no power to convict and disqualify a former office holder who is now a private citizen.”

Very disappointed in Democrats having a vote on witnesses, then backing down almost immediately. Would witness testimony have changed votes? Maybe a few, but never enough to convict. But this was such a monumental and unfortunate event in American history, I can't help but think that every avenue - every - should have been explored as exhaustively as possible.

And as much as I hate to say it, this is how you radicalize people and turn them towards violence - by instilling a feeling a hopelessness that their governmental, legal, and judiciary systems are no longer working.

They only reversed the decision when Republicans like Lindsey Graham voted yes and vowed to call tons of witnesses and drag the trial out forever. Which would just fuck with the Biden administration’s trying to actually get things done.

Let the justice department and the legal system go after Trump, where subpoenas actually mean something.

Edit: Note that the Democrats could have put on the biggest dog and pony show known to man, a full-blown witness extravaganza full of pathos that could bring people weeping to their knees and it wouldn’t have gotten one more Republican to vote of “guilty.”

Agree completely. Dem leadership once again shows no will to fight...to win. Call witnesses of all stripes...cops that were injured, family members of people that died, the House members that gave tours, subpoena Trump, McCarthy, etc. REPUBLICANS DRAGGED HILLARY INTO THE 9TH OR 10TH BULLSHIT BENGHAZI HEARING TWO YEARS AFTER SHE WAS SEC OF STATE! All just to hurt her & Dems. And you know what? It worked! That albatross around her neck (bullshit as it was) was one of the million reasons she lost in 2016.

So do the same thing to the Republicans now! Rub their noses in it. Make them OWN 1/6 & Trump as a party. Bludgeon it into the American psyche that Trump and his sycophants in that party full of complicit pigs were responsible for everything that happened that day. Don't sweep this under the rug as quickly as possible. Because unlike Benghazi, this isn't some ginned up charge against them like it was against Hillary. This IS their fault. Make them pay for it in 2022 and going forward until they purge this shit from their party. Instead, they rolled over once again...feckless as ever. And now we're getting a dubious "commission" according to Pelosi to investigate what happened. Considering some Republicans are behind this, I fear for what new powers the government may have coming out of this, a la the Patriot Act & DHS after 9/11. We don't need any new laws or organizations, we need to nail the pricks behind this to the wall, including Trump and his party.

https://www.businessinsider.com/stacey-plaskett-republicans-privately-said-made-the-case-convict-trump-2021-2?utm_source=reddit.com

Because the Republicans who voted to acquit do not believe the Senate is the proper venue to try a former President, in their interpretation of the Constitution.

They believe that the Constitution says that ONLY the Senate can try him while he’s in office (with two remedies available: kick him out of office, to then be available to convict under the criminal justice system, and/or prevent him from holding office in the future). They believe that since he is now no longer protected from the criminal justice system, he should therefore be tried by the criminal justice system.

This also takes them off the hook from being judged by voters in upcoming elections.

And NOTHING the Democratic House Managers did would ever change that.

However, a jury of Trump’s peers finding him guilty as charged will be okay for them to applaud as “justice served.”

The Senate lightly slapping Trump by finding him guilty and “sentencing” him to not being able to run, again? Yeah, that would save us from having to go through this again; but COME ON, is that really JUSTICE???

Fuck no.

Trump needs a PRISON SENTENCE, just like all the people he sent to the Capitol are facing.

A Senate impeachment trial is not a criminal proceeding; it’s wholly a political procedure, in the absence of an available criminal procedure. In this proceeding, there IS an available criminal procedure; therein lies the Constitutional rub.

“McConnell took a problem that the Senate was uniquely positioned to handle — a president's dereliction of duty and violation of his oath of office — and told the nation that it is the job of criminal prosecutors to deal with it.”

EXCEPT there was ONE Article of Impeachment and it wasn’t about dereliction of duty or violation of oath of office; neither of those were cited; the Article was for Incitement of Insurrection (https://www.npr.org/sections/trump-impeachment-effort-live-updates/2021/01/11/955631105/impeachment-resolution-cites-trumps-incitement-of-capitol-insurrection).

I think the House made a mistake in not specifying dereliction of duty as a specific Article. I also think they should have included a specific Article for violating the 14th Amendment.

But I wonder if civil lawsuits will be even more successful than criminal against Trump. He can’t hide from discovery, anymore.

Ultimately, I agree with you. Republicans aren’t gutless. They’re cunning, evil, self-serving little pricks. They are also really stupid. Several of those Republicans plan to run for President in 2024, against Trump. They would have been smart to banish him.

Here is a REALLY interesting article: https://www.washingtonpost.com/outlook/2021/01/12/14th-amendment-insurrection-trump-removal-problems/

Trump is speaking at CPAC next week. He is planning to (of course) denounce what Biden has been doing. Won't be surprised if he announces he's running again too

The man should not be allowed to speak anywhere.

positive spin attempt: maybe his refusal to go away quietly will strengthen the resolve of those that are bringing cases against him? Many of the parties in that position sadly need that push, and whatever nasty shit he says next week should be a good reminder to those people that they can't let this shit go...that they need to make this fucker pay.

And because everything they do is a projection, you can probably identify these registered Republicans by the frequency of the word "cuck" in their social media output.

Senators aren’t impeached. They’re expelled.
that's what I meant.
no accountability, an enablement.

I know it wouldn't happen anyway, much like Trump wasn't convicted.

my co-worker said yesterday, "this might just be a one year vacation. it's possible the Republicans take things back next year, and Trump runs again in 2024. "

I nearly vomited at the thought. I don't see it happening, but sadly, I wouldn't be surprised. either way, i expect the division to grow more in this country, ugh.

"but people like Mcconnel have moved on" ...have they? it wasn't until the votes were tallied that Mitch decided he was done with Trump. if trump is the presumptive nominee in 2024, Mitch will be right behind him.

The RNC told the ex-president's lawyer that it "has every right to refer to public figures as it engages in core, First Amendment-protected political speech." The RNC's response was first reported by Politico.
They are so screwed.

"There's only one way to contribute to our efforts to elect America first Republican conservatives and in turn, make America great again and that's through Save America PAC and DonaldJTrump.com," Mr. Trump said. He repeated the fundraising pitch in a statement Monday night and said, "No more money for RINOS (Republican in name only). They do nothing but hurt the Republican Party and our great voting base - they will never lead us to Greatness."

this all reminds me of the fable where the frog agrees to give the scorpion a ride across the river, because their situation is mutually beneficial, and the scorpion explains to the frog that he won't sting him, because if he does they'll both die, so the frog says OK, and then the scorpion stings the frog. And the frog says "oh god, now we're all gonna die! WHY!?" and the scorpion says "you knew I was a scorpion you idiot. It's what I am."

I just can't decide if the frog is Mitch McConnell or Donald Trump, or the GOP in general. They have so completely destroyed themselves.

There's a dude who stands down on the corner of a busy intersection near me every now and then and he has one of those boxing training punching things, dressed it up in a suit, and taped trumps face too it, and has a sign encouraging people to get out and punch it when theyre stopped at a light. It's fucking hilarious.
