Journalist and activist Erin Schrode wrote in a post on Wednesday that police fired rubber bullets at Standing Rock protesters who have gathered to condemn the DAPL. Her post follows multiple reports that police have used rubber bullets and pepper spray against protesters at Standing Rock.

I was there, briefly, a few weeks back, and it was fucking amazing. Best thing happening in America right now. I don't have nearly as much time for activism stuff these days because I work a lot of hours, especially during the semesters. But I did drive out there and drop off some supplies and stuff. I have friends who were there for a very long time, and one who still is.

I'm pretty worried about how things are gonna go now that Trump won. Even with Hillary I was concerned, because she gave that lukewarm statement about it that seemed really wishy-washy and non-committal. Still, I thought maybe there was some small hope. Now I fear the worst.

The efforts have to be ramped up, I wish the media would cover this shit more!!! I know a lot of celebs have gotten involved but it needs MORE exposure! Obama put a temp restraining order on it, but he's been fucking lukewarm on it, too, as Bernie Sanders said, Obama needs to get rid of that fucking National Guard and send some people over there to watch what's going on and protect the protesters.

AND, why the fuck is that pipeline even going through, didn't Obama stop it? They need to RE-ROUTE that fucking thing.

Anything helps, really. The Standing Rock Sioux and the neighboring tribes all knew going in that they're going up against a cabal of corporate interests with ties all the way to the White House and others that can leverage the media into having zero interest covering what's occurring. Liberal limousine complacency is a thing that has real consequences and the people of Standing Rock are amongst those most affected by it, but we tend to prefer that over the conservatives who roll through nearby towns and use southern strategy style tactics to encourage the white population to give them their votes while throwing us under the bus (since there's not enough of us to line their pockets or hurt them anyway).

There's a lot more I wanted to say, but I'll save it when I'm feeling less anxious. My hands are shaking as I'm typing this. I do feel a lot better seeing this posted here, though. Thanks allegro. :)

DAPL IGNORES 2ND ARMY CORP REQUEST TO STOP CONSTRUCTION FOR 30 DAYS (http://indiancountrytodaymedianetwork.com/2016/11/10/dapl-ignores-2nd-army-corps-request-stop-construction-30-days-166426)

The company, builders of the Dakota Access Pipeline (DAPL), said on Tuesday November 8 that it planned to begin drilling in two weeks—even though at the moment it does not have the easements necessary for it to tunnel under the river legally.

Building without approved easements is a violation of federal law, the Army Corps emphasized.

"Any work must adhere to federal regulations,” the Army Corps said. “Failure to comply can bring legal action. Construction without proper permits or easements in place can result in fines and legal action."

The tribe said nothing will do but a complete environmental impact statement at the least, and a rerouting of the pipeline.
“The only possible path forward for the Standing Rock Sioux Tribe is a decision that denies the easement or subjects it to a full environmental impact statement and tribal consultation,” Archambault said. “The only urgency here arises from DAPL’s reckless decision to build to either side of the Missouri River without a permit. It even continued construction when the U.S. Government asked it to voluntarily stop.”

Demonstrations to protect burial sites and the tribe's water continue around the construction site, and the Standing Rock Sioux tribal leadership is in talks with the Army Corps to de-escalate the situation and move the camp of water protectors, both sides said.

BANK FUNDING PIPELINE IS INVESTIGATING VIOLATION OF STANDING ROCK SIOUX'S RIGHTS AND UNFAIR TREATMENT OF TRIBE (http://www.truth-out.org/news/item/38310-bank-funding-pipeline-will-look-into-violations-of-standing-rock-sioux-s-rights)

The bank's announcement comes nearly two months after an investigation by Food & Water Watch made public the 38 banks backing the controversial Dakota Access/Bakken pipeline. In the weeks following, YES! Magazine published the names and contact information of each bank's CEO. Hundreds of thousands of people shared the article on Facebook, and it was reprinted widely in other media outlets, creating an organized phone and email campaign to protest the banks' involvement. Around the nation, direct action campaigns at bank branches and headquarters have ranged from picketing to civil disobedience ending with arrests.

Banks reported being inundated with phone calls. Several CEO email addresses have been changed.

Something that really made me mad me was when we found out that some counties in Minnesota were sending sheriff deputies over to fight the protesters. Locally there was a big campaign here to call and email our sheriff department and pressure them. I called a bunch of times. They did finally come back, although it wasn't because of our protests, but rather, because the time frame for their commitments had passed. The whole thing was just infuriating. This isn't like when counties send deputies to another state to help with a hurricane or some natural disaster. Why the fuck are we sending our taxpayer-funded public servants over to another state just so they can help a private corporation from Texas fight people who are protesting their shitty illegal pipeline?

The powers that be behind DAPL have also been involved in some really scummy viral campaigns that wouldn't fly at all under FTC if they were able to assess advertising and how it takes place through social media. It's ironic I always get a good chuckle out of the Infowars dregs who accuse every political activist situation they don't agree with as being orchestrated by Soros, but here we have something that's actually taking place. Fast-foward to 16:43 for a primer on the situation.

There are a number of conservatives in ND who are actually pretty upset about the way the situation is being handled especially in regards to the amount of money being wasted on police force, regardless of anyone's stance on the pipeline's construction. It's a sense of disenfranchisement wherein they see Morton County PD getting stars in their eyes from all the attention this is getting and having various other police forces come in to dress up in military gear, not to mention Kevin Cramer (the United States Representative of North Dakota) leaving some of them out in the cold after Trump employed him to write his energy policy (he's one of the most staunch climate change deniers in office and opposes the EPA -- go figure) and giving little attention to much else since then other than trying to ensure the pipeline gets built.

Why?

.....

Because people in North Dakota are racist as fuck. The Native Americans are largely segregated from the rest of the state outside their reservations and said segregation is made possible since it's largely rural wherein most towns keep to themselves. It was the one state that wasn't affected during the Great Depression and is so isolated that it has mostly gotten away with not following the rest of the country as it becomes more socially liberal. I'd go as far as to say that even the civil rights movement of the 60's hasn't had any effect on the state -- they literally might as well have been on an entirely different planet.

Out of curiosity, do you guys feel like the oil boom may play a part in people's feelings about all this?

I've read a lot about how much has changed in North Dakota in the aftermath of the boom, how some towns had their whole culture and economy transformed overnight. I know a Somali guy who was an oil worker out there a couple years back, and he talked the other oil workers giving him a real hard time, having to deal with a lot of harassment about being black and Muslim and whatnot. I've also read a lot about how the housing/rent market has been totally transformed. I experienced myself a couple years ago when I drove through Dickens and tried to get a hotel room and saw that the cheapest one was like $175 because so many oil workers had started using the hotels for housing which drove the prices way up. Seems like the whole area is going through some really dramatic changes.

I'm just speculating here, but I suspect that a lot of North Dakota people feel pretty positive about the oil industry right now. And so maybe they aren't very sympathetic to a pipeline protest? Maybe it's kind of like trying to protest a new coal mine in a region where their economy is tied to coal. But that's all just my personal speculation, of course.

What do you guys think? How do most ND residents feel about the boom?

There were positives and negatives with the boom. Positives were a ton of jobs came into town, and our minimum wage went up a bunch. We now have more businesses and restaurants, and a whole lot more places to live. Negatives: the rent went up a criminal amount. My rent for my 2 bedroom apartment went from $450 to $3200 a month. You pretty much had to work 3 jobs to pay that. Crime went up drastically. That annoyed pretty much everyone up here because the most that ever happened on a weekend was a few DUIs and now people are shooting each other in bars. I had someone break into my house while I was sleeping. The boom pretty much started in the middle of the worst flood our town has ever seen.

A couple of years ago, the boom stopped, most people left and everything leveled out. Now the protest brought a lot of people back and we're on the news everyday. People are annoyed and just hate anything that brings a lot of attention. As someone mentioned up thread, racism has a big role in it as well. The native Americans aren't highly regarded by alot of people here. The asset protection at our Walmart are told to focus on them when they come into the store. It's kinda crazy.

TL;DR people here are too easily annoyed by anything that upsets the quiet small town thing we got going on up here, even if it brings positives.

Exactly. The girl that was hit is 21. And there were multiple witnesses. Why people are automatically siding with the cops just astounds me, but they'd rather have jobs than care about people and their water getting fucked up.

They don't care that this pipeline was RE-ROUTED FROM BISMARCK because it was deemed to be an EPA hazard to the water supply. But, sure, it's perfectly okay to put it under the Native's only water supply without doing an environmental impact study. This is akin to Flint, with the addition of digging up ancient burial grounds.

Pretty much this.

I just moved from Fargo this summer but had been living there for the last 13 years. I too would think this has little to do with the boon in itself as well. Like raptors said all that's pretty much over now. As far as the Natives are concerned, I thought everyone knew we (pretty much everyone not native) don't talk about them anymore (major sarcasm). I think this whole protest kind puts a big spot light on that fact by how it is and really isn't being covered in the mainstream. I personally think the whole issue of Native American rights get generally disregarded and shit on for the most part.

Allegro- "I assume it's kinda like the "You-Pee" or Michigan's Upper Peninsula, which is basically a bunch of rednecks but they mostly HATE Native Americans because Natives get to fish as much as they want, blah blah blah, but the rednecks just bitch about how the Indians are a bunch of drunks on American free land, fuck them, blah blah blah. Again, pretty much this though i doesn't just apply to rednecks. The racism is real.

"We are aware of the information about the woman on social media who has claimed she sustained injuries to her arm due to law enforcement tactics. The injuries sustained are inconsistent with any resources utilized by law enforcement and are not a direct result of any tools or weapons used by law enforcement." - Lt. Tom Iverson, ND Highway Patrol. Below is a picture of a propane tank found on the bridge following an explosion early Monday morning. Officers witnessed protesters rolling the cylinder on the bridge, saw the explosion and then witnessed protesters running on the bridge to carry a woman from the scene.
1. That propane tank looks awfully intact for an "explosive".

2. Remnants of concussion grenades (including one that didn't detonate) were recovered from the scene. (https://www.facebook.com/ProlificTheRapperOfficial/posts/575312542662392)

Sophia's father put out a statement being made aware of Morton County claiming there were no concussion grenades used. Morton County Sheriff: "We don't have water cannons, we have fire hoses"

"Lying motherfucker"

The sheriff’s department said that water cannons were brought in to control the crowds and extinguish fires set by protesters.

“There are multiple fires being set by protesters on the bridge and in the area of the bridge,” department spokeswoman Donnell Hushka told CNN. “We have firetrucks on the scene. They are using their fire hoses to put out the fires, wet the land around so fires don’t spread, and they are also using water as crowd control.”

I would take these accounts with a huge a grain of salt... they seem to mostly be from non-natives or people from outside of Standing Rock. Identity politics and white guilt are so completely beside the point in this situation especially considering the fact that Sophia Wilansky (the girl who may get her arm amputated) is Jewish. The Sioux Nation are going to be appreciative of all the help they can get.

I did that thing again where I typed out an entire essay during a psychotic episode after the Army Corps. of Engineers issued a statement saying that Sacred Stone camp will be considered to be trespassing if they don't leave on December 5. Oddly enough, this will be the day after some 600 veterans have planned to arrive in Standing Rock to stand with the protestors. I refrained from posting it because this entire situation stresses me the fuck out and I'm pretty embarrassed in my inability to maintain rationality in the face of all this. Anyway...

The Army Corps of Engineers has decided to deny a permit for the construction of a key section of the Dakota Access Pipeline.

The decision essentially halts the construction on the 1,172-mile oil pipeline about half a mile south of the Standing Rock Sioux Reservation. The decision is also a victory for the thousands of demonstrators across the country who flocked to North Dakota in protest.

Feels like a punt... I'm seeing celebration about this announcement but this entire situation's left me pretty jaded and on my toes simultaneously in the event that this might not actually mean anything. Ugh.

I'm really weary. This Army Corps. of Engineers has a long history of fucking over the indigenous peoples and (within recent history) have only been acting as stenographers for the corporate interests that have completely uprooted our federal government.

I don't think there were proper impact studies to begin with, that's the problem. This is Federal land (well, actually, it's Reservation land that was annexed) so the Feds have full power to stop construction but they won't. They can shut work down without a permit but won't, They can shut work down pending impact studies. They can enforce that. But will they? It depends on if this administration wants to give a shit or wants it to be a giant pimple on Trump's ass, especially now that Vets are acting as human shields.

It sucks that it came to this, having read this: http://www.forbes.com/sites/richardepstein/2016/09/14/why-the-doj-order-to-shut-down-construction-on-the-dapl-pipeline-is-legally-indefensible/

The White House’s directive today to the Corps for further delay is just the latest in a series of overt and transparent political actions by an administration which has abandoned the rule of law in favor of currying favor with a narrow and extreme political constituency.
As stated all along, ETP and SXL are fully committed to ensuring that this vital project is brought to completion and fully expect to complete construction of the pipeline without any additional rerouting in and around Lake Oahe. Nothing this Administration has done today changes that in any way.

What that article isn't saying is that it's big money vs. a bunch of unrepresented Indians who didn't know the right way to go up against big money oil companies or the government. Lack of adequate representation. A full environmental impact study should have been done, as it was in Bismarck (which shut down the project and re-routed it). Near the current site, only an environmental "assessment" was done, which is a quick-and-dirty and cheap way to push through this project, not NEARLY as comprehensive as a full impact study. The fear of having pipelines under rivers and lakes is due to disasters like this (https://en.wikipedia.org/wiki/Kalamazoo_River_oil_spill). Or these (https://en.wikipedia.org/wiki/List_of_pipeline_accidents_in_the_United_States_in _the_21st_century). And this (http://bismarcktribune.com/news/state-and-regional/pipeline-crews-cleaning-up-oil-leak-near-neche/article_3d106188-ff89-11de-a138-001cc4c002e0.html).

The Department of Justice (as well as the United Nations) saw that these indigenous people were unrepresented in this matter and even though you can offer them "meetings" that does not mean that they will be "heard" and they know this, they know it's mere protocol "for the record" so that the record can show that there was a meeting or meetings, but not that any of the tribes' concerns would be actually acknowledged and considered and appropriate actions would taken, and there is a high level of mistrust, here, where these Native Americans truly do not trust the white man based on literally hundreds of years of sneaky bamboozling and treatment, so that is why the easement was denied the other day and a full impact study has now being done and that pipeline to be re-routed as that is the Native American's only source of water, plus the pipeline is digging up areas of ancient burial sites.

This has happened against these Indians COUNTLESS times in the past, where they have been taken advantage of, their land stolen from them, etc., without adequate representation, without the finances to hire big guns like that, without the legal understanding as to the proper way to fight this, etc. The above article is deliberately weighted to show the oil company's and the government's "oh well" attitude.

So in the two previous videos I posted, a few people did some viral footwork in tracing the plate numbers of the van which the harasser was using to tail the two people you see in the car... and it turns out the van itself is the vehicle used for inmate transfers via Morton County. If I allow myself to be the most cynical person to walk this dark green/yellow/gray/brown earth, I would get the feeling that Sunoco and Energy Transfers are paying Morton County under the table.

Well, yeah, that seems REALLY obvious considering all of this "interest" in so fervently "protecting" that area. It appears that pretty much every law enforcement agency out there is being paid A LOT of money to be out there; otherwise, there would be zero incentive to be there.

Also, I watching THIS INTERVIEW (https://www.youtube.com/watch?v=UjCSGalmFns) last night with this woman who went there as a trauma counselor and who was arrested initially for "trespassing" but was then charged, with a whole bunch of other praying females, for "arson" and a bunch of other bogus FELONY charges, these women were told to PROVIDE THEIR DNA, which is fucking CRAZY. That video was horrible; women not provided with DIABETES MEDICATION and one woman's sugar count was up over FOUR HUNDRED, old women not given their heart meds, they're gonna KILL SOMEBODY, for sure. These women weren't even near any location where anything like that was going on, then they come back after having been in two jails, and the entire hill (where the ancient burial ground is located) is ON FUCKING FIRE. Why would the Native Americans burn their own fucking burial grounds? Answer: THEY WOULDN'T. Of course, these charges won't stick but abusing people and NEARLY KILLING THEM BY DENYING THEM MEDS: Cruel and unusual punishment, NEVER MIND the human rights violations by forcing them to provide fucking DNA and if they don't, then you threaten them with more "felony" charges by "non-compliance."

what a bunch of fucking hillbillies. Of COURSE the oil companies are behind all of this. Why else would these law enforcement agencies spend all of these state and county RESOURCES on this shit where there aren't enough other revenues and taxpayers to pay for it?

Why I Joined My Fellow Vets at Standing Rock This Weekend (https://www.aclu.org/blog/speak-freely/why-i-joined-my-fellow-vets-standing-rock-weekend?emsrc=Nat_Appeal_AutologinEnabled&emissue=freespeech&emtype=petition&ms=eml_161206_freespeech_policemilitarization_stan dingrock&__af=query_string_encrypted), written by a former Marine and retired Air Traffic Controller (and father of an ACLU staff member).

I also received the following email from the ACLU:

On Sunday, just hours before the evacuation notice for the main protest camp at Standing Rock was to take effect, the Army Corps of Engineers denied a permit for the Dakota Access Pipeline to drill under the Missouri River – halting the pipeline construction.

This is a testament to the organizing power and resilience of the Standing Rock Sioux Tribe, whose members have been fighting to protect their water and defend their sovereignty for more than nine months.

Over a quarter million ACLU supporters joined this fight. More than 250,000 of you called on the Department of Justice to demilitarize the police force confronting the nonviolent protesters and investigate possible constitutional violations. Over 46,000 of you sent a message to the Corps telling them not to silence free speech and shut down the biggest encampment at Standing Rock.

This fight is not over yet. The Corps must now consider alternate pipeline routes and will need to complete an Environmental Impact Statement, which could take months or years. The Standing Rock Sioux and other tribal leadership will continue to be key participants in this process.

We will continue to pressure the Department of Justice to hold police fully accountable for civil rights abuses committed against water protectors – including the many hundreds who have been detained and face criminal charges.

And we’ll continue to be vigilant should the Trump administration move to authorize construction on the pipeline.

For the moment, we celebrate this victory. And we will continue to fight to protect the rights of protesters, at Standing Rock and beyond.

Thank you for all that you have done,
Anthony for the ACLU Action team

I received the following email from the White House today:

Dear [redacted]:

Thank you for writing. I want you to know that I am listening, and I appreciate your perspective.

On December 4, the Department of the Army indicated that it will not approve an easement for the proposed Dakota Access pipeline to cross under Lake Oahe and that more work is necessary to explore alternative routes. The Department stated that it has been having discussions with officials from the Standing Rock Sioux Tribe who expressed concerns about the risk that a rupture or spill could pose to the tribe’s water supply and treaty rights. The Department indicated that consideration of alternative routes would best be accomplished through an Environmental Impact Statement with full public input and analysis.

As President, my greatest responsibility is ensuring the safety of the American people. That includes protecting the rights of all our citizens, as well as the integrity of our energy infrastructure. My Administration has been committed to setting the highest possible standards for oil and gas production and transportation and to making sure our pursuit of energy resources does not put our communities or the environment at risk. As new energy infrastructure is developed, the Federal government works with State, local, and tribal governments—which play a central role in the siting and permitting of pipelines—to address the concerns of local communities. That’s one reason why Federal agencies have engaged in a series of consultations open to leaders from all 567 Federally‑recognized tribes about how the Federal government can improve its working relationship with tribal governments on infrastructure‑related issues. We have made a great deal of progress in building a brighter shared future with Indian Country, and we remain committed to strengthening our nation‑to‑nation relationships as we tackle the work that must still be done.

Again, thank you for writing. I am optimistic that together, we can grow our economy and create new opportunities while securing a cleaner and safer future for all our people.

Sincerely,

Barack Obama

It's nice, but of course it is kinda useless knowing the incoming administration of oil terror starts in less than a month.
