Actually, in this case, I'd say the RIAA is actually doing something useful.

Quote:
Assistant U.S. Attorney Brett Grayson said Pritchard is believed to have made more than $70,000 selling bootleg compact discs — a figure based on shipping receipts, banking records from the Florida wholesaler and a ledger kept by Hubbell.

Agents seized from Pritchard a “CD tower” capable of burning five compact discs at once and said he was selling copies from his personal library of more than 1,000 bootleg recordings.

The guy was selling CD-R bootlegs, he's getting what he deserves.[/quote]

I believe the current law defines infringing as both the sale for profit, and the distribution, even by electronic means.

So, the question then becomes, if you aren't seeding or uploading more than five torrents at once, is it okay. Wink

I don't believe it's possible to make over $1.5 million in 4 year selling bootlegs.
I didn't know they sue for bootlegs too.
"something about nails" ...it's pathetic

Fuck RIAA.

well actually yes, you're right.

People who aren't on the internet like we are. People who are on the internet but can't wrap their head around torrents.

I'm glad these guys got busted, but I wonder - where does the money go? Will Trent see any of that cash?

I doubt it! I bet the Sherriff's Dept. or Police force of some kind gets that. It probably gets stored in an evidence room for a period of time before the court date and the after court it ***mysteriously disappears*** from the evidence room. Even if it ended up legit, I'd imagine TR wouldn't see any of the money.

The RIAA probably keeps most of it and then gives the rest to the poor record labels who were so cruelly stolen from Rolling Eyes

The RIAA is not concerned about the artists getting paid their royalties, they are only concerned about themselves.
My guess is that the guy was not making more than $5 off of each cd.
How is that different than the wholesale price of a cd, which is what the artist's royalty is based from, and the retailer marking it up $7?
I don't recall the exact amount that NIN cd's were being marked up in Australia, but wasn't the price almost double cd's by other artists. That money was going into the retailer and possibly the record companies pockets. Nobody sued them, at least to my knowledge.
Unless the artist is themselves releasing recordings of their live concerts (which some do), then your not taking sales away from the artist. The market for these type of recordings is the avid (possibly obsessed) fan, not the casual fan. They are meeting a need that is not being met by the artist.
I remember back in the 80's (despite the substances ingested in the intervening years) the easiest way to get bootlegs was to buy them at a record store. You might know some people that were tapers, and you could get stuff from them. But, the times have changed, and not only is trading widely available but so are torrents. If this guy was doing this for over ten years, and he made $70k, that's not really that much money. How much of a profit is too much?
Let's say that Faction had continued to fulfill t-shirt orders. He is/was technically infringing on the NIN trademark. How much of a profit was he making? He could be sued (not just buy disgruntled customers), should he be sued just because he was making money off of NIN. It's not like NIN was selling those exact t-shirts.

I heard The Good Soldier on Freedom Radio in Iraq on Tuesday. That was the first time I had heard that one. Usually its Closer or HLAH.

TGS and EDIETS are staples around here too. I hear those a LOT coming out of random garage areas, vehicles, etc.

My friend and I burned a bunch of discs full of NIN (40 of them so far) and labled them with various things like "Listen" and "music to get you thru another day here" and shit like that and left them at a bunch of the bus stops and various high traffic places on the base. (there are busses that shuttle you around because the place is so spread out) We are hoping to spread our love of NIN with the masses, and maybe turn a few new people on to NIN. (hey, we got a lot of down time on our hands out here) Smile

They were done with Itunes since most people here use that, and that way they can see the artist, and from what album etc when they put it in their computer.

p.s. i like pie

Shouldn't THE GOOD SOLDIER be "censored" by the army over there ? It's the last song that would motivate anyone to want to fight that war. I really wonder how the soldiers are, if you guys think like in the song, if you feel like pawns, if you question your presence there.

Hmmm, where to begin with this one...

The radio here isn't for "motivation". It's purely for entertainment. They play a really nice eclectic mix on that station too. Now when they play "Closer" the fucks are edited (unfortunately).

I would say that I can speak pretty safely for the majority, that yes, we do indeed feel like pawns, but anyone who joins any branch of the military should realize that that is exactly what you are going to be, to an extent.

Questioning our presence here? Depends on who you ask. I personally see a LOT of really great things that we are doing for the people here. Things that would without our presence, never be made available for some of them (medical care, education, safety, democracy, overall quality of living etc.) So in that respect, No, we don't question our presence. But on the big agenda political scale, probably. It's much much easier here if you don't get your head wrapped around too much political bullshit and just do your job, and don't over-think it.

well, we tried to give them intriguing lables to avoid that happening. hopefully it worked Smile

Now, back on topic, I forgot to mention that I also saw and AIR sticker on the window of a HMMVW a few weeks ago. THAT gave me goose bumps!!

I must be getting old, as I'm unsure what this means. Are you trying to say that after the show you felt like you got forcibly penetrated without your consent? It's the only way I'm making sense of it.
